A legal malpractice action by client, the intended beneficiary of a living trust, to recover damages from attorney who negligently drafted the trust for the decedent. The attorney failed to effectuate clear and specific testamentary transfers of personal property in favor of client, as clearly intended by decedent. As a result of attorney’s negligence, client did not receive, among other things, several items of personal property that decedent desired her to have including two paintings, which had both sentimental and significant monetary value.

This case presented complicated, cutting-edge, and rigorously fought legal issues regarding attorney-client privilege and third-party beneficiary status. The case ultimately settled for a confidential amount by which client was able to recover about 50% of the value of the personal property.
